1. Acceptance of Terms
These Terms are an agreement between you and Yada Investments L.L.C, a limited liability company licensed in Abu Dhabi, United Arab Emirates, which publishes and operates Fein ("we," "us," or "our"). By downloading, installing, accessing, or using Fein ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
You must be at least 13 years old to use the Service, or at least 16 if you live in the European Economic Area (the European Union, Iceland, Liechtenstein and Norway, as the EEA Agreement defines them) or in Switzerland. This applies when you create an account, and we check it when you sign up. The age rating that the App Store or Google Play shows for the app is the store's guide for downloading it; it does not change these minimum ages. When you sign up we ask for your date of birth and, in current versions of the app, the country you live in, and we keep an age range and, if you are 13 to 17, the year you turn 18, never the date. We block and delete accounts that, from your answers and your phone's settings and internet connection, appear to be below these ages (Section 9 of our Privacy Policy explains how). If we learn later that an account belongs to someone below the minimum age, we delete it too. If you are under 18, or under the age of majority where you live, you may use the Service only with the permission of a parent or legal guardian.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.

Fein is a group location tracking application that provides real-time location sharing, safety monitoring, and emergency response features. The Service includes:

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
You must provide accurate, current, and complete information when creating your account and keep it updated. You may not share your account credentials with others or allow others to access your account.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:
We do not tolerate objectionable content or abusive users. You can report a message or a person, and block someone, in the app. We review reports, and we may remove content and suspend or end the account of anyone who breaks these Terms.
5. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Our Privacy Policy explains how we handle personal data under the UAE PDP Law, the GDPR, the UK GDPR and Data Protection Act 2018, and the CCPA, and the rights you have.
To keep the Service working, the app sends crash reports to Sentry (Functional Software, Inc.), a service provider that processes them on our behalf and stores them in the European Union. Section 2.4 of our Privacy Policy explains what a crash report contains, what it never contains, and how long it is kept.
6. Emergency Features
The Service includes emergency features such as SOS alerts. These features are provided "as is" and should not be relied upon as a substitute for emergency services. In case of emergency, always contact local emergency services first. Fein alerts the people you choose, the members of your groups and your emergency contacts; it does not contact emergency services for you, and it cannot guarantee that an alert is delivered, seen or answered.
We are not responsible for any delays, failures, or inaccuracies in emergency response features. Emergency features may not be available in all areas or under all circumstances.
7. Subscription and Payment
The Service is currently free to use. If we introduce paid plans, we will show the price, the billing period and how renewal and cancellation work before you buy. Plans bought through the App Store or Google Play are billed, renewed, cancelled and refunded through your store account, under the store's terms.
8. Intellectual Property
The Service and its content, including but not limited to software, text, graphics, logos, and design, are owned by us or our licensors and are protected by intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission. You retain ownership of content you submit to the Service, but grant us a license to use it for service provision.
9. Service Availability
We strive to provide reliable service but cannot guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.
We are not liable for any damages resulting from service interruptions or failures. We may modify, suspend, or discontinue the Service at any time with reasonable notice.
10. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use.
Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Termination
You may end your account at any time by deleting it in the app's Settings or by contacting us. Deleting the app from your phone does not delete your account. We may terminate or suspend your account for violations of these Terms or for any other reason with reasonable notice.
Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy.
13. Governing Law
These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the UAE.
14. Dispute Resolution
Before pursuing formal legal action, we encourage you to contact us to resolve disputes informally. If informal resolution fails, disputes shall be resolved through binding arbitration in the UAE.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service. Any prior agreements or understandings are superseded by these Terms.
